CEQA Addendum to the City's General Plan EIR
The City, as the Lead Agency, determined that an Addendum to the City’s General Plan 1991 certified Environmental Impact Report (SCH No. 1991021054) was to be prepared in order to evaluate proposed updates to Circulation and Economic Development Elements. The purpose of the Addendum was to evaluate whether the proposed updates would modify the certified EIR in such a way as to result in new environmental impacts or a substantial increase in the severity of previously identified significant effects or would otherwise trigger a need for subsequent environmental review under the California Environmental Quality Act (CEQA).
The proposed General Plan updates would not change the current land use designations or buildout assumptions made under the certified EIR, result in impacts that differ from those identified, and would not trigger the need for preparation of a subsequent or supplemental EIR under the criteria in CEQA Guidelines Sections 15162(a) and 15163(a). Impacts beyond those identified in the EIR would not be expected to occur as a result of the updates, which would still be subject to all applicable, previously required mitigation measures from the certified EIR. The Addendum to the Environmental Impact Report (EIR) assessed the project’s alignment with the Circulation Element and its potential impacts on the community and concluded the project aligns with the adopted plans, programs, and policies.

California Environmental Quality Act (CEQA) Information
What is the California Environmental Quality Act?
The California Environmental Quality Act (CEQA) is a California statute that requires government agencies to analyze, consider, and make available to the public, information about potential environmental impacts that may result from proposed discretionary development projects. This analysis is accomplished through the creation of an initial study analyzing potential impacts from the project proposed, and from this analysis, subsequent preparation of either a negative or mitigated negative declaration (statements of either "no environmental impact" or "no impact with mitigation in place") or an environmental impact report (significant impact(s) likely - detailed environmental analysis required).

Does my project require review under CEQA?
CEQA requires analysis of most discretionary projects. A discretionary project is any action where a public agency (such as the City of Dana Point) exercises judgment in deciding whether to approve a project. Projects that require an agency to merely determine conformance with local standards in order to issue a permit or other entitlement are called "ministerial" projects and are generally exempt from analysis. That stated, certain discretionary projects are also exempt from analysis, and are listed in Article 18 (Statutory Exemptions) and Article 19 (Categorical Exemptions) of the CEQA Statute.
