PURSUANT TO SECTION 9.07.030
OF THE DANA POINT MUNICIPAL CODE, A HOME OCCUPATION MAY BE CONDUCTED IN
ANY RESIDENTIAL DISTRICT SUBJECT TO COMPLIANCE WITH THE PERFORMANCE STANDARDS
CONTAINED THEREIN. THE EXECUTION OF THIS USE AGREEMENT SHALL SERVE AS
OFFICIAL ACKNOWLEDGEMENT BY THE APPLICANT OF THE PROVISIONS OF THE ABOVE-MENTIONED
CODE SECTION. IN SIGNING THIS AGREEMENT, THE APPLICANT AGREES TO ABIDE
BY THESE PROVISIONS.

HOME OCCUPATIONS
IN EXECUTING A USE AGREEMENT
TO PERMIT A HOME OCCUPATION AT THE ABOVE-MENTIONED ADDRESS, I DO HEREBY
CERTIFY:
A) That the applicant
has been provided a copy of Dana Point Municipal Code Section 9.07.030
(Home Occupations); and
B) That the applicant
has concurrently completed a City of Dana Point Business Registration
application; and
C) That, based on the
information provided by the applicant, the nature, condition, and development
of adjacent uses, buildings and structures has been considered, and
the proposal will not adversely affect or be materially detrimental
to the adjacent uses, buildings or structures.

9.07.30 Home Occupations
- The residence in which a home
occupation is conducted shall not display any indication of a
business.
- Only persons residing in the residence
shall be involved in the business; no outside employees shall
be permitted.
- No more than one (1) room of the
residence shall be used for business purposes. Required garages
shall not be used for the business in any manner, including storage
of materials, and no portion of the business shall be conducted
out of doors.
- The business shall generate no
more than ten (10) vehicle trips per day.
- Permitted business equipment shall
be limited to that normally associated with a residential use.
- The business shall not produce
any noise, heat, vibration, glare, dust, or odor effects other
than those ordinarily associated with a residential use.
- No actual retail sales shall be
conducted on the premises other than sales by phone or mail.
